Forms & DIY Kit License Agreement
Version 1.0 — Effective October 2, 2026
This Agreement is between Nurse Registry Consultant, LLC, a Florida limited liability company ("Consultant"), and the person or business identified at checkout ("Buyer"). It covers the purchase of individual forms and the DIY Licensure Kit from nurseregistryconsultant.com. It takes effect when Buyer accepts it at checkout.
Plain-language summary. These are forms and guides Scott Strachan, RN, BSN, has used in his own Florida nurse registry for years. They are a starting point, not legal advice. You are responsible for adapting them to your registry and having them reviewed by your own attorney and accountant.
1. What You Are Buying
Buyer may purchase one or more individual forms, or the DIY Kit. An individual form is a downloadable, editable document. The DIY Kit includes the document library provided with Consultant's Nurse Registry Startup & Compliance Package (including the forms package, Policy & Procedure Manual, Annotated G-Tags, PFAO Workbook, CEMP Template, and survey preparation workbooks) and access to the Path to Licensure guides on Consultant's website. Product descriptions on the website at the time of purchase are part of this Agreement.
2. License to Use
Consultant grants Buyer a non-exclusive, non-transferable license to use and modify the purchased materials for the internal operations of one nurse registry owned or operated by Buyer. Buyer may not sell, share, publish, distribute, or provide the materials, in original or modified form, to any other person or business, including other registries, consultants, or form services. Each additional registry requires its own purchase.
3. Access Periods
Individual forms: Buyer may download each purchased form for 90 days from purchase. Buyer keeps the files downloaded during that time.
DIY Kit: Buyer has access to the DIY Kit materials and the Path to Licensure guides for six (6) months from purchase.
After an access period ends, Consultant has no obligation to keep materials available. Buyer should download and save what it needs.
4. Upgrades
Buyer may upgrade anytime within six (6) months of Buyer's first purchase: from individual forms to the DIY Kit, or from individual forms or the DIY Kit to the Nurse Registry Startup & Compliance Package.
Everything Buyer has paid counts toward the upgrade price.
The six-month window and all access periods run from Buyer's first purchase date. They do not restart or stack when Buyer upgrades.
An upgrade to the Package is governed by the Package agreement in effect at the time of the upgrade.
5. What the DIY Kit Does Not Include
The DIY Kit does not include coaching or mock survey sessions, document review, survey-day support, AI tools (including Consultant's custom GPTs), or any other personal services. Personal guidance is available separately through Consultant's Hourly Review & Advisory service or by upgrading to the Package.
6. Not Legal, Accounting, or Professional Advice
The materials are forms and guides Consultant has used in its own nurse registry operations, shared as a starting point. They are not legal, accounting, tax, or regulatory advice. Consultant is not Buyer's attorney, accountant, or regulatory representative, and no professional relationship is created by this purchase. Consultant recommends that Buyer have all final documents reviewed by its own attorney and accountant before use.
7. No Guarantee
Consultant does not guarantee licensure approval, survey results, regulatory compliance, or business outcomes from using the materials. Results depend on Buyer's own operations, decisions, and implementation. Buyer relies on its own independent judgment for all business, operational, and compliance decisions.
8. Independent Contractor Status
Using Consultant's independent contractor forms, including the IC Referral Agreement, does not by itself establish that any caregiver is an independent contractor. Classification depends on how Buyer actually operates and on the applicable federal and state tests. Buyer is solely responsible for how it classifies, refers, and works with caregivers.
9. Buyer's Responsibility to Customize and Keep Current
The materials are a starting point, not a final product. Buyer is responsible for:
Adapting them to its own registry, services, policies, and practices
Making sure they comply with current federal, state, and local law
Updating them when laws, rules, or AHCA requirements change
The materials reflect Consultant's understanding as of their preparation date. Laws, rules, and AHCA requirements change, sometimes without notice, and Consultant has no obligation to update materials already delivered.
10. AHCA Materials and Annotations
The G-Tags and survey workbooks are published by the Florida Agency for Health Care Administration (AHCA). Consultant's annotations and highlights are Consultant's professional opinion based on experience. Consultant is not affiliated with or endorsed by AHCA, and AHCA's current published requirements control over any annotation.
11. Payment and Refunds
Prices are shown at checkout and paid in full through Stripe. Because the materials are digital and available immediately, all sales are final and non-refundable, including unused access time. Charges will appear as NURSE REGISTRY ADVISOR.
12. Billing Questions and Disputes
Buyer agrees to contact Consultant at [email protected] about any billing concern before disputing a charge with its bank or card issuer. Consultant will respond within two business days. If a payment is disputed or reversed, Consultant may suspend access while the dispute is pending and will provide records of acceptance and delivery to the payment processor.
13. Disclaimer of Warranties
The materials are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of fitness for a particular purpose, accuracy, or completeness, to the fullest extent permitted by law.
14. Limitation of Liability
To the fullest extent permitted by law, Consultant's total liability arising from this Agreement or the materials will not exceed the amount Buyer paid for them. Consultant is not liable for indirect, incidental, consequential, regulatory, business, or financial damages, including fines, citations, lost revenue, or licensure delays.
15. Indemnification
Buyer will defend, indemnify, and hold harmless Consultant from claims, liabilities, damages, penalties, costs, and attorney's fees arising from Buyer's use or modification of the materials, Buyer's operations, caregiver conduct, client care, or regulatory actions, except in cases of Consultant's gross negligence or intentional misconduct.
16. Ownership
Consultant owns all rights in the materials, including the forms, templates, guides, and annotations. Buyer may not remove copyright notices or footers from the materials except as needed to adapt them for its own internal use.
17. Electronic Acceptance; Business Purpose
Buyer is purchasing for business purposes. Buyer accepts this Agreement by checking the agreement box and completing payment. Electronic acceptance has the same effect as a handwritten signature, and Consultant keeps a record of the date, time, IP address, and agreement version.
18. Governing Law; Entire Agreement
This Agreement is governed by Florida law, with exclusive venue in Lee County, Florida. The prevailing party in any dispute may recover reasonable attorney's fees and costs. This Agreement incorporates the Terms of Service; if they conflict, this Agreement controls. Changes must be in writing. If any provision is unenforceable, the rest remains in effect.
